{"id":490,"date":"2020-05-12T10:17:05","date_gmt":"2020-05-12T08:17:05","guid":{"rendered":"https:\/\/web.reynesadvocat.com\/hello-world-10\/"},"modified":"2021-11-16T12:31:26","modified_gmt":"2021-11-16T11:31:26","slug":"derecho-del-trabajo","status":"publish","type":"post","link":"https:\/\/www.reynesadvocat.com\/es\/derecho-del-trabajo\/","title":{"rendered":"DERECHO DEL TRABAJO"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><p>[vc_row][vc_column][vc_column_text]<strong><u>EL TSJ DE CATALU\u00d1A DECLARA LA NULIDAD DEL DESPIDO DE UNA TRABAJADORA EN SITUACI\u00d3N DE BAJA AL HABER MANIFIESTO EL REPRESENTANTE DE LA EMPRESA EN EL ACTO DE JUICIO QUE DESPIDIR TRABAJADORES EN SITUACI\u00d3N DE BAJA ES POL\u00cdTICA DE LA EMPRESA.<\/u><\/strong><\/p>\n<p>Si bien es conocido que la declaraci\u00f3n judicial -habitual- al despido de trabajadores en situaci\u00f3n de baja m\u00e9dica sin causa es la de \u00abimprocedencia\u00bb, la Sala de lo Social del TSJ ha declarado la nulidad del despido por la vulneraci\u00f3n del derecho a la integridad f\u00edsica del art\u00edculo 15 CE, con derecho a la readmisi\u00f3n en el mismo puesto de trabajo y con abono de sueldos de tr\u00e1mite, adem\u00e1s de una cuant\u00eda de 18.000\u20ac por vulneraci\u00f3n de derechos fundamentales por la siguiente raz\u00f3n:<\/p>\n<p><em>\u201cUna pol\u00edtica de empresa tendente a despedir a quien ha estado frecuentemente en situaci\u00f3n de incapacidad temporal es un factor de segregaci\u00f3n de quienes se vean en la necesidad de situarse en tal estado, en la medida en que es una amenaza gen\u00e9rica y \u2014a la vez\u2014 directa, claramente disuasoria para las personas trabajadoras de hacer uso del derecho fundamental a proteger su propia integridad f\u00edsica. Y concurre una afectaci\u00f3n negativa a la salud de los trabajadores, en la medida en que siendo esto p\u00fablico las personas que est\u00e1n enfermas dif\u00edcilmente coger\u00e1n un bajo por incapacidad temporal, porque corren el riesgo de ser despedidas\u201d.<\/em><\/p>\n<p>El TJUE en 2016 ya abri\u00f3 la puerta a la nulidad del despido por discriminaci\u00f3n en bajas m\u00e9dicas de larga duraci\u00f3n al ser asimilables a la \u201cdiscapacidad\u201d, a pesar de tener en cuenta que esta conclusi\u00f3n no opera autom\u00e1ticamente.<\/p>\n<p>Estas sentencias relevantes son una evidencia de que es necesario estudiar de forma espec\u00edfica cada caso.[\/vc_column_text][\/vc_column][\/vc_row]<\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>El TSJ de Catalu\u00f1a declara la nulidad del despido de una trabajadora en situaci\u00f3n de baja al haber manifiesto el representante de la empresa en el acto de juicio que despidir trabajadores en situaci\u00f3n de baja es pol\u00edtica de la empresa.<\/p>\n","protected":false},"author":1,"featured_media":722,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[6],"tags":[],"class_list":["post-490","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-sin-categorizar","category-6","description-off"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.6 -
